Abstract

This article analyzes the objective and subjective factors influencing the formation and development of judges' professional legal consciousness. Objective factors include the legislative framework, the institutional structure of the judicial system, and the socio-economic environment. Subjective factors encompass judges' level of education, personal ethical values, professional skills, and psychological characteristics. The article presents a polemical discussion based on the theoretical views of foreign legal scholars, particularly Ronald Dworkin, H.L.A. Hart, Lon Fuller, and Jerome Frank, regarding legal consciousness and judicial activity. The analysis emphasizes the importance of improving the education system, ensuring judicial independence, and strengthening ethical norms to enhance judges' legal consciousness.
